1. Agreement to Terms
By accessing or using TalkyPaste ("the Service"), you agree to these Terms. The Service is operated by Ralph Cohen, based in the Netherlands.
2. Description of Service
TalkyPaste is a voice-to-AI tool delivered through Apple Shortcuts on iOS and macOS. It allows users to dictate voice input, which is transcribed and processed by an AI model. The response is automatically copied to the clipboard.
TalkyPaste is not a standalone application — it runs as an Apple Shortcut and relies on Apple's Shortcuts framework and an internet connection.
3. Device Identification
No traditional accounts required. A unique device identifier (UUID) is generated locally on first use, stored in iCloud Drive. You are responsible for activity associated with your device identifier.
4. Free Tier and Subscription
Free Tier: 25 free messages to evaluate the Service. We may change this limit at any time.
Paid Subscription: Continued use requires a monthly subscription via Lemon Squeezy, LLC as Merchant of Record.
Auto-Renewal: Subscriptions auto-renew unless cancelled. Cancel anytime via your Lemon Squeezy portal. Access continues until the end of the billing period.
5. Refund Policy
Because of the free tier, all subscription payments are non-refundable. By subscribing, you waive your right of withdrawal under Article 6:230p of the Dutch Civil Code. See our Refund Policy.
6. Acceptable Use
You agree not to generate illegal, harmful, or abusive content; circumvent usage limits; reverse-engineer the Service; use automated queries; or resell access.
7. AI-Generated Content
AI responses may contain errors. The Service is not a substitute for professional advice. You are responsible for how you use AI-generated content.
8. Intellectual Property
TalkyPaste branding, API, and technology are property of Ralph Cohen. You retain ownership of your input and output.
9. Availability
We strive for high availability but do not guarantee uninterrupted access. We may modify or discontinue any aspect of the Service at any time.
10. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid in the 12 months preceding the claim.

12. Governing Law
Governed by the laws of the Netherlands. Disputes submitted to the competent court in Amsterdam.
